The introduction to the law of obligations as well as the annotation of the §§ 241-243 has changed significantly through numerous developments in the administration of justice and literature, but particularly also through the law modernizing the law of obligations. The volume was therefore essentially revised so that a lot that was discussed in the earlier edition on § 242 is now found in § 241. That applies especially to the realization of the different secondary obligations of the debtors. The attachment to § 241 enables a clearer systemization than the discussion in § 242 with the difference between performance-oriented secondary obligations and consideration obligations. At the same time, the growing meaning of § 241 within the new default law is taken into account. With the annotation of § 242, a completely new concept was chosen, which enabled a better access to information. It can already be seen that the general realization of § 242 stays as close to the text as possible. The discussion of individual cases of use is modeled contrary to a common approach not on the different working areas of § 242, because as far as it goes, there are no generally recognized dividing criteria. The description follows instead the system of the German Civil Code and the other fields of law. The annotation of § 242 clearly won through in clarity and transparency.
