In particular, the Freiburg School and the idea of freedom of competition are taken into account. The democracy of the German constitution is examined with a view to its roots. On the basis of the Facebook decision of the German Federal Court of Justice, it is shown how the results of this thesis can be recognized in jurisprudence.
